Due process requires that the procedures by which laws are applied must be evenhanded, so that individuals are not subjected to the arbitrary exercise of government power. The requirements of due pro-cess are determined in part by an examination of the settled usages and modes of proceedings of the common and statutory law of England during pre-colonial times and in the early years of this country. However, it does not follow that a procedure settled in English law and adopted in this country is, or remains, an essential element of due process of law. A court proceeding is not a req-uisite of due process. Due process may also require an opportunity for confrontation and cross-examination, and for discovery; that a decision be made based on the record, and that a party be allowed to be represented by counsel. The purpose of this requirement is not only to ensure abstract fair play to the individual.
